Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the LayerOP website at layerop.cc, the LayerOP desktop application, and related services (collectively, the “Service”). By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms.

1. Who we are

The Service is operated by Deaf Pumpkin Studios, LLC, a limited liability company incorporated in Delaware, with a registered address at 2810 North Church Street, PMB 80252, Wilmington, DE 19802, USA. Contact: hello@layerop.cc.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. What LayerOP is

LayerOP is a gaming knowledge overlay. It can detect which game you are playing and help answer in-game questions while you play. It is not a cheat, bot, input automation tool, or game-memory reader. It does not inject into, hook, or modify game clients.

Answers are generated using artificial intelligence and may be incomplete or incorrect. You are responsible for how you use any information provided by the Service.

4. Accounts and devices

Some features require a free LayerOP account. You are responsible for keeping your login credentials secure and for activity under your account. You may link one or more devices to your account, subject to plan limits.

You must provide accurate registration information and keep it up to date. We may suspend or terminate accounts that contain false or misleading information.

5. Plans and subscriptions

LayerOP offers a free tier and a paid “Overpowered” subscription. Plan features, limits, and pricing are described on our pricing page and may change with reasonable notice.

Overpowered subscriptions renew automatically at the end of each billing period (monthly or annual, depending on what you selected) unless you cancel before renewal. Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis.

You can manage or cancel your subscription through your account billing settings or the Stripe customer portal. Cancellation stops future charges; you will generally retain paid features until the end of the current billing period.

6. Refunds

If you are not satisfied with Overpowered, contact us at hello@layerop.cc and we will work with you on a refund. We aim to be fair and reasonable. Refund eligibility may depend on how recently you were charged and how the Service was used. Nothing in this section limits any mandatory rights you may have under applicable consumer protection laws.

We may throttle, suspend, or terminate access if we reasonably believe you have violated these Terms or are abusing the Service.

8. Screen capture and submitted content

The desktop app may capture screenshots of your game screen for two purposes only: (1) to identify which game you are playing, and (2) when you optionally attach a screenshot to a question on the Overpowered plan. We do not access your files, installed programs, microphone, webcam, keyboard input, or other applications.

Questions, messages, screenshots, and related request data you submit through the Service are stored and handled as described in our Privacy Policy, including current retention periods for messages, images, and server logs.

9. Intellectual property

The Service, including software, branding, and content we provide, is owned by Deaf Pumpkin Studios, LLC or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership rights. Game titles, logos, and trademarks belong to their respective owners; Deaf Pumpkin Studios, LLC is not affiliated with any game publisher or developer.

You retain ownership of content you submit (such as questions and screenshots). You grant us a limited license to store, process, and retain that content for the periods described in our Privacy Policy solely to operate, secure, and improve the Service.

10. Third-party services

The Service relies on third parties such as payment processors (Stripe), AI model providers (e.g. OpenAI, Anthropic, and others), email delivery services, and web search infrastructure. Your use of those services may also be subject to their terms and policies.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANSWERS WILL BE ACCURATE OR UP TO DATE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DEAF PUMPKIN STUDIOS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations. In those cases, our liability is limited to the maximum extent permitted by law.

13. Termination

You may stop using the Service at any time. You may request account deletion by emailing privacy@layerop.cc.

We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.

14. Governing law

These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law principles. Where mandatory consumer protection laws in your country of residence give you rights that cannot be waived by contract, those rights remain unaffected.

15. Changes

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on layerop.cc and update the effective date. Continued use after changes take effect constitutes acceptance of the revised Terms.
